Plain English — not legal advice.
Under ch. 240 § 240-22, compliant rental property operators ensure that all garbage and refuse storage containers on the property are made of approved flame-resistant materials and that no waste accumulates in shared hallways or stairwells. Operators typically communicate waste collection requirements—including those in Chapter 183—to tenants at move-in and through posted notices, and they maintain systems that make proper disposal accessible. Keeping records of tenant communications about waste rules can support a showing of compliance if questions arise.

Section 240-22 of the Newburgh Code of Ordinances sets out specific obligations for tenants regarding garbage disposal, including not placing loose bags outside the building or in garage areas and not leaving interior furniture outdoors except for proper disposal under Chapter 183. If a landlord is failing to provide adequate sanitary facilities or approved storage containers as required by this provision, tenants may have grounds to raise that failure with the appropriate city authority. Tenant-rights organizations in the Newburgh area can help residents understand what options are generally available when sanitation conditions at a rental property fall short of code requirements.
