Newburgh, N.Y., Code of Ordinances ch. 38 § 38-7
Complaint procedure
Operative Text
A. Any person claiming to be aggrieved by any unlawful discriminatory practice may, by himself or by his attorney, make, sign and file with the Fair Housing Officer a certified complaint, which shall state the name and address of the person or persons alleged to have committed the unlawful discriminatory practice complained of and which sets forth the particulars thereof and contains such other information as may be requested by the Office. B. After the filing of the complaint, the Fair Housing Office shall make a prompt investigation in connection therewith. C. If, in his judgment, the circumstances so warrant, the Fair Housing Officer may at any time after the filing of the complaint endeavor to eliminate such discriminatory practice by conference, consultation and persuasion. D. In the case of failure to eliminate such discriminatory practices, the Fair Housing Officer, in conjunction with the Corporation Counsel of the City of Newburgh, may issue an order to cease and desist such discriminatory practices and further initiate positive mechanisms to effectuate the intent of this chapter. E. Nothing contained in this chapter shall be construed so as to limit or prohibit investigation by any other governmental unit of competent jurisdiction, nor shall anything contained herein limit any aggrieved party from pursuing any remedy available therefrom. In the event of such a situation, the Fair Housing Officer is hereby empowered to place any and all of its material obtained through the investigation at the disposal of such other governmental unit.
Newburgh, N.Y., Code of Ordinances ch. 38 § 38-7 establishes a formal complaint process for individuals who believe they have experienced unlawful housing discrimination. A complaint is filed with the Fair Housing Officer, who then investigates and may attempt to resolve the matter through conference and persuasion. If informal resolution fails, the Fair Housing Officer, working with the City's Corporation Counsel, can issue a cease-and-desist order and take further steps to enforce the chapter's intent. The provision also preserves the right of other government agencies to conduct their own investigations and of aggrieved parties to pursue other available remedies.
Plain English — not legal advice.
Under Newburgh, N.Y., Code of Ordinances ch. 38 § 38-7, a complaint filed against a property owner or manager triggers a prompt investigation by the Fair Housing Officer. Operators who are the subject of a complaint may be contacted for conference or consultation as part of an informal resolution effort before any formal order is issued. If discriminatory practices are not eliminated through that process, a cease-and-desist order can be issued in conjunction with the Corporation Counsel, making early cooperation with the Fair Housing Office a standard part of compliant property management practice.

Newburgh, N.Y., Code of Ordinances ch. 38 § 38-7 gives individuals who believe they have faced unlawful housing discrimination the right to file a certified complaint with the Fair Housing Officer, either personally or through an attorney. Once a complaint is filed, the Office is required to conduct a prompt investigation and may work toward an informal resolution; if that fails, a cease-and-desist order can be pursued. The provision also makes clear that filing with the Fair Housing Office does not foreclose other remedies — tenants may simultaneously or alternatively pursue relief through other governmental bodies or legal channels, and tenant-rights organizations can help identify which paths may be available.
