North Tonawanda, N.Y., Code of Ordinances ch. 51D § 51D-10
Enforcement inspection criteria and authority
Operative Text
A. Upon the rental dwelling unit registering with the Code Enforcement Office, the owner of the rental dwelling unit consents to the inspection of the dwelling unit by the Code Enforcement Office or another designated representative. The Code Enforcement Office, or designated representative, may make an inspection of the rental dwelling unit to determine whether or not such rental dwelling unit is in substantial compliance with this chapter and the New York State Uniform, Fire Prevention and Building Code. At the conclusion of said inspection, the Code Enforcement Office, or designated representative, shall provide the owner, or the owner's representative, at the inspection with a copy of the results of the inspection. B. If the results of the inspection conducted pursuant to § 51D-10A above demonstrate that the dwelling unit is in substantial compliance with this chapter and the New York State Uniform, Fire Prevention and Building Code, the owner shall be entitled to retain his/her rental dwelling unit certificate.
North Tonawanda Code of Ordinances ch. 51D § 51D-10 establishes that registering a rental dwelling unit with the Code Enforcement Office constitutes the owner's consent to inspections of that unit. Inspectors evaluate whether the unit substantially complies with local chapter requirements and the New York State Uniform Fire Prevention and Building Code. At the end of an inspection, the owner or their representative on-site receives a written copy of the inspection results, and a unit found in substantial compliance allows the owner to keep the rental dwelling unit certificate.

Under ch. 51D § 51D-10, registering a rental unit with the Code Enforcement Office carries with it an automatic consent to inspection, so compliant operators ensure their properties are maintained in accordance with both the local chapter and the New York State Uniform Fire Prevention and Building Code before and during any inspection. Having an owner or authorized representative present at the inspection is important, as that person receives the written results directly at the conclusion of the visit. Operators who achieve a finding of substantial compliance are entitled to retain their rental dwelling unit certificate, making routine upkeep and proactive code compliance central to uninterrupted rental operations.

Section 51D-10 of North Tonawanda's Code of Ordinances creates a framework in which rental units are subject to inspection by the Code Enforcement Office to verify they meet local and state building and fire safety standards. Tenants living in registered rental units benefit from this oversight, as inspections are designed to confirm that housing conditions meet the requirements of the New York State Uniform Fire Prevention and Building Code. Tenants who believe their unit has unaddressed code issues may consider contacting the North Tonawanda Code Enforcement Office directly or reaching out to a local tenant-rights organization to understand available options.
