North Tonawanda, N.Y., Code of Ordinances ch. 51D § 51D-8
Every holder of a rental dwelling unit certificate shall: A. Conspicuously post the certificate in a protected mounting in the public corridor, hallway or lobby of the building for which the certificate was issued. This posting shall be in a common entrance. If no common entrance exists, then the posting shall be made at the entrance of each dwelling unit. An alternative to such posting, the certificate shall be produced by the owner, or other responsible parties at the request of the tenant, a prospective tenant, or upon the demand of the Code Enforcement Office. B. Conform with all other applicable state, county, and local laws and regulations on matters not specifically addressed in this chapter. C. The rental agreement or lease for a dwelling unit regulated under this chapter must include a disclosure of the smoking policy for the premises on which the dwelling is located. The disclosure must state whether smoking is prohibited on the premises, allowed on the premises, or allowed in limited areas on the premises. If the smoking policy allowed smoking in limited areas, the disclosure must specify the areas on the premises where smoking is permitted.

North Tonawanda Code ch. 51D § 51D-8 establishes three core duties for holders of a rental dwelling unit certificate. The certificate must be visibly posted in a common area or, where no common entrance exists, at each unit's entrance — and must be made available on request to tenants, prospective tenants, or the Code Enforcement Office. Certificate holders must also comply with all other applicable laws not covered by ch. 51D, and every rental agreement or lease must include a written disclosure of the property's smoking policy, specifying whether smoking is prohibited, fully permitted, or allowed only in designated areas.

For Property Managers

Operators holding a rental dwelling unit certificate under North Tonawanda Code ch. 51D § 51D-8 generally keep the certificate mounted in a protected display in a shared corridor, hallway, or lobby — or at each unit entrance if no common entry exists — and have it readily available to show tenants, prospective tenants, or Code Enforcement upon request. Compliant operators also ensure their lease or rental agreement contains a clear smoking-policy disclosure that identifies whether smoking is banned entirely, permitted throughout the premises, or restricted to specific designated areas. Maintaining these practices alongside adherence to all other applicable state, county, and local regulations is characteristic of a certificate holder in good standing under this chapter.

For Tenants

Under North Tonawanda Code ch. 51D § 51D-8, tenants and prospective tenants have the right to see the property's rental dwelling unit certificate — either posted in a common area or produced on request by the owner or another responsible party. Tenants are also entitled to a written smoking-policy disclosure within their lease or rental agreement, detailing exactly where, if anywhere, smoking is permitted on the premises. Those who believe a certificate holder is not meeting these obligations may contact the North Tonawanda Code Enforcement Office to report a potential violation, or consult a local tenant-rights organization to understand available options.
