Plain English

Oneida, N.Y., Code of Ordinances ch. 77 § 77-107 establishes that chimneys, flues, and vents in any structure used for human habitation must be structurally sound and free from defects that would impair their intended function. These components must also generate sufficient draft to support the rated output of any connected equipment, and where flue linings are required, they must be durable, smoke-tight, and capable of withstanding flue gases. The rule applies to all such draft-producing systems, not just primary chimneys, ensuring that the full ventilation and exhaust infrastructure meets a consistent safety standard.

For Property Managers

Under ch. 77 § 77-107 of the Oneida Code of Ordinances, compliant property operators generally maintain chimneys, flues, and vents in structurally sound condition and schedule periodic inspections to identify defects before they compromise function. Operators typically verify that all connected equipment receives adequate draft to reach its rated output and that flue linings, where required, remain smoke-tight and durable. Keeping records of inspections, repairs, and any professional assessments of draft-producing equipment is a common practice among operators seeking to demonstrate ongoing compliance.

For Tenants

Section 77-107 of the Oneida Code of Ordinances gives occupants of residential structures a basis to raise concerns when chimneys, flues, or vents appear structurally compromised, show visible defects, or fail to properly vent connected appliances. Tenants who observe such conditions may report them to the local code enforcement or housing inspection office responsible for administering ch. 77, which can trigger an official inspection. Tenant-rights organizations in New York can help residents understand how to document conditions, what to expect from the complaint process, and what options may be available if violations are found.
