Oneida, N.Y., Code of Ordinances ch. 77 § 77-88
A. Habitable space shall have a minimum ceiling height of seven feet over 50% of the floor area; and the floor area where the ceiling height is less than 4 1/2 feet shall not be considered in computing floor area. B. Every alcove less than 60 square feet in area, except a cooling space or foyer, shall be deemed to be part of a habitable room. The area of the opening in the dividing partition between the alcove and the room shall be at least 80% of the wall area of such partition, measured on the alcove side, but not less than 40 square feet. The depth of such alcove shall not exceed half its width. The floor area of the alcove shall be added to the floor area of the room in determining light and ventilation requirements for the room. An alcove with an area of 60 square feet or more, but less than the required area of a habitable room, shall be separately lighted and ventilated as required for habitable space.

Plain English

Oneida, N.Y., Code of Ordinances ch. 77 § 77-88 establishes minimum size and ceiling-height standards for habitable space. At least half of a room's floor area must have a ceiling height of seven feet, and any portion with a ceiling below four and a half feet does not count toward the room's measured floor area. Small alcoves under 60 square feet are generally treated as part of the adjoining room, subject to specific rules about the size of the opening between them, the alcove's proportions, and how its area factors into light and ventilation calculations; larger alcoves that still fall short of a full habitable room's required area must have their own independent lighting and ventilation.

For Property Managers

Operators managing residential units in Oneida should ensure that every habitable space meets the ceiling-height thresholds set out in ch. 77 § 77-88, documenting that at least 50% of each room's floor area clears seven feet. When a unit includes alcoves, compliant operators verify whether each alcove falls above or below the 60-square-foot threshold, confirm that connecting openings meet the 80%-of-wall-area (and at least 40-square-foot) requirement, and check that depth-to-width ratios and lighting or ventilation provisions are satisfied before the space is offered for occupancy. Keeping floor plans and ceiling-height measurements on file can help demonstrate compliance during inspections.

For Tenants

Tenants living in Oneida residential units have an interest in knowing that § 77-88 of ch. 77 sets enforceable minimums for ceiling height and room dimensions, including rules about how alcoves are measured and whether they must be separately lit and ventilated. If a rented space appears to fall short of these standards—for example, if a significant portion of a room has a very low ceiling or an alcove lacks required lighting—tenants can document the conditions and report concerns to the local code enforcement or building department. Consulting a tenant-rights organization familiar with Oneida's housing code can help clarify what options are generally available when a unit may not meet habitable-space requirements.
