Section 77-95 of Oneida's Code of Ordinances establishes physical and locational standards for toilet rooms and bathrooms in residential buildings. In multiple dwellings, bathrooms must be inside each dwelling unit and reachable from sleeping rooms without passing through another sleeping room, while floors must be fully waterproof with waterproofing extending at least six inches up the walls. In one- and two-family homes, bathroom floors must be moisture-resistant, and all shower enclosures everywhere must have waterproof floors and water-resistant walls. Where employees work in multiple dwellings and number five or more, separate-sex restrooms are required that do not open directly into food-preparation areas.
Plain English — not legal advice.
Operators of multiple dwellings subject to § 77-95 generally ensure that each dwelling unit contains its own bathroom accessible from sleeping areas without routing through another sleeping room. Compliant buildings feature fully waterproof bathroom floors with waterproofing running at least six inches up the walls, moisture-resistant wall coverings, and waterproof shower enclosures throughout. Where five or more employees are on-site, property managers typically maintain separate restroom facilities for each sex that are kept away from any kitchen or food-preparation space.

Under § 77-95, tenants in multiple dwellings have a right to a bathroom located within their own unit and accessible from sleeping areas without passing through another sleeping room. If a bathroom lacks proper waterproofing, moisture-resistant materials, or privacy provisions as described in this section, that condition may constitute a housing code violation. Tenants who believe their unit does not meet these standards can document the conditions, raise the issue with their landlord in writing, file a complaint with the local code enforcement or housing authority in Oneida, or reach out to a tenant-rights organization for general guidance.
