Plain English

Section 149-23 of Oswego's Code of Ordinances establishes safety standards for fireplaces and similar open-burning fixtures in residential and other buildings. The rule requires that such fixtures connect to approved chimneys, that their fire-exposed components be made of heat-resistant materials that won't degrade under high temperatures, and that any wood mantels or trim be positioned so they cannot reach unsafe temperatures or be ignited by sparks or embers. The provision addresses the full assembly—from the chimney connection to the decorative surround—as an integrated fire-safety system.

For Property Managers

Operators of properties subject to Oswego Code ch. 149 § 149-23 generally ensure that every fireplace is connected to a code-approved chimney and that the installation keeps surrounding combustible materials and structural members away from unsafe heat levels. Compliant operators use hearth linings and firebox components made of materials rated to withstand direct flame without melting, spalling, or disintegrating. Wood mantels and decorative trim are typically secured at distances and in configurations that prevent ignition from sparks or embers, and routine inspections help confirm that these conditions remain in place over time.

For Tenants

Tenants living in units with fireplaces have an interest in knowing that the installation meets the standards set out in Oswego Code ch. 149 § 149-23, which covers chimney connections, heat-resistant firebox materials, and safe placement of wood mantels and trim. If a fireplace appears to have cracked linings, improperly positioned woodwork, or a chimney connection that seems deficient, tenants can document the condition and report it to the City of Oswego's code enforcement office. Tenant-rights organizations and legal aid services can help residents understand what remedies or complaint processes may be available under local housing and building codes.
