Oswego, N.Y., Code of Ordinances ch. 149 § 149-68
Inspection
Operative Text
A. Inspectors shall be authorized and have the right, in the performance of their duties, to enter any premises during normal business hours and in emergencies whenever necessary to protect the public interest. B. Owners, agents, operators and occupants shall be responsible for providing access to all parts of the premises within their control to authorized Engineering Department personnel acting in the performance of their duties.
Oswego Code ch. 149 § 149-68 establishes that city Engineering Department inspectors have the authority to enter rental premises during normal business hours, and in emergency situations whenever the public interest requires it. The rule also places a corresponding obligation on owners, agents, operators, and occupants to provide access to all parts of a property that are within their control when authorized personnel arrive to perform their duties. Together, these two provisions create a mutual framework: inspectors hold an entry right, and those connected to the property hold an access-facilitation duty.
Plain English — not legal advice.
Under Oswego Code ch. 149 § 149-68, compliant property owners and managers generally ensure that authorized Engineering Department personnel can reach all areas of the premises—including common areas, mechanical rooms, and individual units—during normal business hours without obstruction. Operators typically maintain clear records of who holds access authority for various parts of the property so that inspections can proceed smoothly. Because the provision also covers emergency entry, operators commonly have protocols in place to respond to after-hours contact from city inspectors when public-interest emergencies arise.

Oswego Code ch. 149 § 149-68 makes clear that occupants, not just owners, share responsibility for providing access to the parts of a premises within their control when authorized Engineering Department inspectors arrive. Tenants generally have an interest in understanding what constitutes "normal business hours" under this provision and what documentation inspectors should carry to confirm their authorization. Tenants who have questions about how this inspection authority interacts with their privacy rights may find it useful to consult a tenant-rights organization or review the broader provisions of ch. 149 for additional context.
