Peekskill, N.Y., Code of Ordinances ch. 332 § 332-21
Removal of posted notice
Operative Text
No person shall deface or remove the posted notice from any dwelling, dwelling unit, lodging house, lodging unit, rooming house or rooming unit, which has been designated as unfit for human habitation except as provided in § 332-20 above.
Section 332-21 of Peekskill's Code of Ordinances prohibits anyone from defacing or removing an official notice that has been posted on a dwelling, dwelling unit, lodging house, lodging unit, rooming house, or rooming unit that has been declared unfit for human habitation. The only exception to this prohibition is the process described in § 332-20, which governs how such a designation may be lifted. The rule applies broadly to all persons, meaning neither owners, occupants, nor third parties may tamper with the posted notice outside of that authorized process.
Plain English — not legal advice.
Property owners and managers subject to an unfit-for-habitation designation under Peekskill's Code ch. 332 should be aware that § 332-21 makes it a violation for any person—including the owner—to deface or remove the official posted notice. Compliant operators generally leave the notice intact and pursue the formal remediation and reinspection pathway outlined in § 332-20 as the only authorized route to having the notice removed. Interfering with the posted notice before completing that process can constitute a separate violation independent of the underlying habitability issues.

Under § 332-21 of Peekskill's Code ch. 332, tenants living in or near a unit posted as unfit for human habitation have an interest in knowing that the notice is legally protected from removal or defacement by anyone, including a landlord, until the conditions described in § 332-20 are satisfied. If a tenant observes that a posted notice has been tampered with or removed without the property having gone through the proper reinstatement process, that may be reportable to the local code enforcement or housing authority in Peekskill. Tenant-rights organizations familiar with Westchester County housing law can help explain what options are generally available when posted notices are interfered with.
