Peekskill, N.Y., Code of Ordinances ch. 435 § 435-5
Definitions
Operative Text
As used in this chapter, the following terms shall have the following meanings: OWNER-OCCUPIED A property shall be deemed owner-occupied when at least one record owner of the property occupies at least one dwelling unit therein as his/her principal year-round residence. PROPERTY MANAGER Any person, firm, corporation or other entity responsible, whether for pay or not, for the day-to-day management of the property as evidenced by such factors, including, but not limited to, responsibility for renting units, maintenance of the property and collection of rents, or other acts taken on behalf of the property owner in the management of the property.
Section 435-5 of Peekskill's Code of Ordinances Chapter 435 establishes the working definitions for two key terms used throughout the chapter. A property is considered 'owner-occupied' only when at least one person who holds record title to the property lives in one of its dwelling units as their primary, year-round home. A 'property manager' is broadly defined as any individual or entity — paid or unpaid — who handles day-to-day operations such as renting units, collecting rent, or maintaining the property on behalf of the owner.
Plain English — not legal advice.
Under § 435-5, the definitions of 'owner-occupied' and 'property manager' can affect which obligations and exemptions apply to a given property under Chapter 435. Operators who claim owner-occupied status generally ensure that at least one record owner maintains the property as a genuine principal year-round residence, not merely a part-time or secondary address. Those who delegate day-to-day tasks — such as leasing, maintenance, or rent collection — to another person or company should be aware that such a delegate may qualify as a 'property manager' under this section, regardless of whether compensation is involved.

Section 435-5 sets out definitions that shape how other provisions of Peekskill's Chapter 435 apply to a rental situation, including whether a property qualifies as owner-occupied. Tenants may find these definitions relevant when evaluating whether their building is subject to specific requirements or exemptions elsewhere in the chapter. Those with questions about how these definitions affect their rights can consult a local tenant-rights organization or seek guidance from the City of Peekskill's relevant municipal offices.
