Under Port Jervis, N.Y., Code of Ordinances ch. 319 § 319-20, property owners and managers who receive an adverse determination from the enforcement officer have a formal avenue to seek review. A compliant operator generally documents the basis for any appeal carefully, demonstrating either that the enforcement officer's interpretation was incorrect or that strict application of the chapter creates a practical difficulty or unnecessary hardship warranting a variance. Operators typically submit their appeal to the Board of Appeals within any applicable deadlines and provide supporting materials that address the specific grounds for relief.
