Plain English

Port Jervis, N.Y., Code of Ordinances ch. 430 § 430-7 establishes that a special legal proceeding to remove a tenant from rented premises can be initiated when those premises, or any portion of them, have been used or occupied for illegal drug use or possession. The provision broadens the definition of 'tenant' beyond its ordinary meaning to include rooming house occupants and long-term hotel residents who have stayed 30 consecutive days or more, explicitly excluding transient occupants. This rule creates a specific eviction ground tied to illegal drug activity on the property.

For Property Managers

Under Port Jervis, N.Y., Code of Ordinances ch. 430 § 430-7, property owners and managers who have documented evidence that a rental unit or any part of their property has been used for illegal drug activity have a recognized legal basis to pursue a special eviction proceeding. Compliant operators typically maintain records of incidents, law enforcement reports, or other documentation that supports such a claim before initiating any proceeding. Operators should also be aware that the provision's expanded definition of 'tenant' may apply to rooming house and long-term hotel occupants, not just traditional lease holders.
