For Property Managers

Under ch. 12 § 12-102, compliant property operators generally ensure that below-grade spaces such as basements, cellars, and crawl spaces are maintained in a condition reasonably free from moisture buildup. Operators typically verify that cross ventilation is achieved through openings on opposing walls, or through mechanical ventilation or dehumidifiers that have received Building Inspector approval. Routine checks of aggregate ventilation area against the code's square-footage thresholds help demonstrate ongoing compliance with this provision.

For Tenants

Section 12-102 of Poughkeepsie's Code of Ordinances gives occupants of residential structures a basis to expect that below-grade spaces are kept reasonably dry and properly ventilated. If a basement, cellar, or crawl space shows signs of persistent dampness or inadequate ventilation, tenants may have grounds to raise this as a housing condition concern with local code enforcement or the Building Inspector's office. Tenant-rights organizations familiar with Poughkeepsie housing code can help residents understand what documentation and reporting options may be available to them.
