Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-21
Rules and regulations
Operative Text
(a) The head of the Code Enforcement Agency is authorized to make and adopt such written rules and regulations as may be necessary for the proper enforcement and interpretation of this Chapter and to secure the intent thereof. Such rules and regulations shall not be in conflict with the provisions of this Chapter or any other ordinance of the city, nor shall they have the effect of waiving any provisions of this Chapter or any other ordinance. Such rules and regulations shall have the same force and effect as the provisions of this Chapter, and the penalty for violation thereof shall be the same as the penalty for violation of the provisions of this Chapter. (b) Such rules and regulations shall be submitted to the local legislative body by the head of the Code Enforcement Agency. Failure of the local legislative body to approve, reject or modify such rules and regulations within 30 days after submission shall be deemed to constitute approval thereof. Said rules and regulations, as approved by the local legislative body, shall be on file and available as a matter of public record.
Under Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-21, the head of the Code Enforcement Agency has authority to create written rules and regulations to clarify and carry out Chapter 12, provided those rules do not conflict with or waive any existing city ordinances. Once drafted, the rules must be submitted to the local legislative body, which has 30 days to approve, reject, or modify them — silence within that window counts as approval. Approved rules carry the same legal weight as the Chapter itself, and violations of those rules are subject to the same penalties as violations of the Chapter's core provisions.
Plain English — not legal advice.
Property owners and managers operating under Chapter 12 should be aware that, per § 12-21, the Code Enforcement Agency may issue supplemental written rules that carry the full force of the ordinance. Compliant operators generally monitor the public record for any newly adopted rules and regulations, since those rules are filed and available for public inspection after legislative approval. Treating agency-issued rules with the same seriousness as the underlying Chapter provisions is consistent with how § 12-21 frames their legal effect.

Section 12-21 of Poughkeepsie's Code of Ordinances ensures that any rules the Code Enforcement Agency adopts to implement Chapter 12 are publicly available as a matter of record, giving tenants a way to review the full scope of enforceable standards that apply to their housing. Because these rules carry the same legal weight as the Chapter itself, tenants may be able to raise a violation of an agency-issued rule in the same manner as a violation of the ordinance's core text. Tenants seeking to understand which rules are currently in effect can consult the public file maintained under § 12-21, or reach out to a local tenant-rights organization for guidance on accessing those records.
