Plain English

Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-4 establishes that virtually every residential dwelling in the city — regardless of when it was built, renovated, or permitted — must meet the minimum housing standards set out in Chapter 12. The only category carved out is temporary housing. These standards govern both the initial occupancy of a dwelling and its ongoing condition, and they operate alongside, rather than in place of, other applicable construction or equipment codes, except where Section 12-5 provides otherwise.

For Property Managers

Under ch. 12 § 12-4, compliant property owners and managers treat Chapter 12's minimum housing standards as a baseline obligation that applies to every residential building they operate in Poughkeepsie, no matter how old the structure is or what permits were issued before January 1, 1963. Operators generally conduct ongoing assessments of their properties to ensure continued compliance, not just compliance at the time a unit is first occupied. Because § 12-4 does not displace other building or equipment codes, operators typically track all applicable regulatory frameworks simultaneously.

For Tenants

Section 12-4 of Poughkeepsie's Code of Ordinances ch. 12 means that tenants in virtually any residential dwelling — old or new — are entitled to housing that meets the city's minimum standards, and a landlord cannot point to the building's age or prior permits as a reason those standards don't apply. If a dwelling appears to fall short of these standards, tenants may have the option of filing a complaint with the appropriate Poughkeepsie municipal authority, raising a housing-code violation as a defense in relevant legal proceedings, or reaching out to a local tenant-rights organization for guidance on available options.
