Plain English — not legal advice.
Under ch. 12 § 12-76, compliant property operators generally ensure that all outdoor areas are routinely cleared of debris, organic waste, and other potentially hazardous materials. They supply appropriate covered metal or plastic containers for temporary garbage and rubbish storage, and they do not use incineration as a disposal method. Flammable materials found on the premises are either properly stored in a safe manner or removed to keep the property in compliance.

Section 12-76 of the Poughkeepsie Code of Ordinances gives occupants a basis to expect that exterior property areas are maintained free of health, fire, and accident hazards, with proper refuse containers provided. If a property's outdoor areas are not kept clean, lack adequate covered containers, or contain improperly stored flammable materials, tenants may consider documenting the conditions and reporting them to the appropriate local code enforcement or housing authority. Tenant-rights organizations in the Poughkeepsie area can help residents understand what options are generally available when exterior maintenance standards are not being met.
