Poughkeepsie, N.Y., Code of Ordinances ch. 12 § 12-8
Saving clause
Operative Text
This Chapter shall not affect violations of any other ordinance, code or regulation of the city existing prior to January 1, 1984, and such violation shall be governed and shall continue to be punishable to the full extent of the law under the provisions of those ordinances, codes or regulations in effect at the time the violation was committed.
Section 12-8 of Poughkeepsie's Code of Ordinances Chapter 12 is a saving clause that preserves the legal effect of older city rules. Any violation of a city ordinance, code, or regulation that occurred before January 1, 1984 remains subject to the penalties and enforcement mechanisms that were in place at the time of that violation. The adoption of Chapter 12 did not wipe out or reduce liability for those earlier infractions.
Plain English — not legal advice.
Property owners and managers should be aware that Chapter 12, § 12-8 does not provide any shelter from enforcement actions tied to pre-1984 violations of Poughkeepsie city ordinances. A compliant operator keeps records of any historical code matters and understands that older violations remain fully enforceable under the rules that existed when they occurred. This provision signals that the city's regulatory history carries forward alongside current requirements.

Section 12-8 clarifies that tenants' rights and remedies connected to housing-code violations predating January 1, 1984 are not extinguished by the enactment of Chapter 12. If a pre-1984 violation is relevant to a housing dispute, the standards and penalties from the ordinances in effect at that time still apply. Tenants dealing with historical code issues may wish to consult a tenant-rights organization or legal aid office familiar with Poughkeepsie's regulatory history to understand what protections may still be available.
