(3) Residential occupancies in buildings of mixed occupancy. (4) Accessory structures, accessory to residential occupancies. B. Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-3 defines the scope of the city's residential property code by specifying which properties fall under its rules and which do not. The code covers a broad range of residential settings—including single-family homes, two-family homes, multi-unit buildings, mixed-use buildings with residential occupancies, and related accessory structures—along with the land on which they sit. However, the code explicitly carves out mobile homes, mobile home courts, and transient or temporary housing arrangements such as hotels, motels, nursing homes, and farm labor camps from its requirements.

Property owners and managers operating in Rensselaer should be aware that § 121-3 determines whether their buildings are subject to the obligations set out in Part 1 of Chapter 121. Operators of standard residential rental properties—including one- and two-family homes, apartment buildings, and mixed-use buildings with residential units—generally fall within the code's reach and are expected to maintain compliance accordingly. Owners of facilities that qualify as transient or temporary housing, such as hotels or nursing homes, should review Subsection B carefully to confirm whether their property type is excluded.

Section 121-3 of Rensselaer's Code of Ordinances establishes which residential properties are protected by Part 1 of Chapter 121, and most renters in standard apartments, multi-family buildings, or mixed-use residential units are likely covered. Tenants who believe their housing conditions fall under this code's scope can reference § 121-3 when raising concerns about whether the code's protections apply to their building. Those with questions about applicability or potential violations may find it useful to contact the City of Rensselaer's code enforcement office or reach out to a local tenant-rights organization for general guidance.
