Plain English

Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-36 establishes standards for the outdoor areas of residential and other properties. It requires that water drainage be properly managed, that fences and minor structures be kept in safe condition, that paved surfaces remain safe for normal use, and that yards be kept free of trash and hazardous plant growth. Swimming pools subject to city laws and insurance rules must have their fences inspected annually, and vacant or unsupervised large properties receive particular attention for overgrowth violations.

For Property Managers

Property owners and managers operating under ch. 121 § 121-36 generally ensure that drainage infrastructure—gutters, catch basins, and similar systems—is functional and prevents standing water. Compliant operators routinely inspect and maintain fences, walkways, driveways, and parking areas for safety, keep yards clear of trash and debris, and eliminate heavy or noxious plant growth. Those with swimming pools on-site should be prepared for the yearly fence inspections required by this section and applicable city and insurance rules.

For Tenants

Section 121-36 of Rensselaer's Code of Ordinances gives tenants a basis to expect that outdoor areas—including drainage systems, fences, walkways, yards, and vegetation—are kept in a safe and sanitary condition by whoever is responsible for the property. If these conditions are not met, tenants may document the issues and report them to the appropriate city code enforcement office, which has authority to inspect and require corrections. Tenant-rights organizations can help residents understand what options are available, including raising a code violation as part of a broader housing complaint.
