Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-44
Conflicts with other regulations
Operative Text
A. The provisions of this Part 2 shall supersede local laws, ordinances, codes or regulations to the extent that such laws, ordinances, codes or regulations are inconsistent with the provisions of this Part 2 , provided that nothing herein contained shall be construed to prevent the adoption and enforcement of a law, ordinance or regulation which is more restrictive or establishes a higher standard than those provided in this Part 2 , and such more restrictive requirement or higher standard shall govern during the period in which it is in effect. B. In a case where a provision of this Part 2 is found to be in conflict with a provision of a zoning, building, electrical, plumbing, fire, safety, health, water supply or sewage disposal law or ordinance, or regulation adopted pursuant thereto, or other local law, ordinance, code or regulation, the provision or requirement which is the more restrictive or which establishes the higher standard shall prevail.
Section 121-44 of Rensselaer's Code of Ordinances establishes a hierarchy for resolving conflicts between Part 2 and other local rules. When Part 2 conflicts with another local law, ordinance, or regulation—whether related to zoning, building, fire safety, plumbing, or similar subjects—the more restrictive or higher-standard provision controls. Part 2 does not prevent any other authority from adopting stricter requirements; those stricter rules simply take precedence for as long as they remain in effect.

Property owners and managers operating in Rensselaer should be aware that § 121-44 means compliance with Part 2 alone may not be sufficient if another applicable local rule—such as a building, fire, or zoning ordinance—sets a stricter standard. Compliant operators generally identify all overlapping regulations and apply whichever requirement is most demanding. Keeping current with any amendments to local codes that interact with Part 2 is a routine part of responsible property management in this jurisdiction.

Under § 121-44, tenants benefit from a rule that always defaults to the strongest applicable protection when local regulations overlap. If a housing condition is governed by both Part 2 and another local ordinance—such as a fire safety or health code—the stricter of the two standards applies. Tenants who believe a landlord is relying on a less protective rule to avoid a higher obligation may find it useful to consult a tenant-rights organization or contact the relevant local enforcement agency to clarify which standard governs.
