Plain English

Rensselaer, N.Y., Code of Ordinances ch. 121 § 121-8 establishes how residential buildings are sorted into occupancy categories for regulatory purposes. Single- and two-family homes with four or fewer lodgers per unit fall into one category, while buildings with more units, more lodgers, or specialized uses such as dormitories, lodging houses, and apartment hotels fall into the 'multiple dwellings' category. Accessory structures like garages and carports on residential property form a third, separate classification. The category a building falls into determines which rules apply to it under Part 1 of the code.

For Property Managers

Property owners and managers in Rensselaer should be aware that § 121-8 determines which regulatory requirements apply to their buildings based on occupancy type. A one- or two-family home shifts into the 'multiple dwellings' classification if more than four lodgers reside with a family in a unit, which can trigger a different set of obligations. Compliant operators generally verify their building's correct classification before renting units, adding lodgers, or converting structures, since the classification affects which code provisions govern the property.

For Tenants

Under § 121-8, the classification of the building where a tenant lives affects which protections and standards apply to that property. Tenants in buildings that qualify as 'multiple dwellings'—such as apartment houses, lodging houses, or buildings with three or more units—may be entitled to a different set of code-based protections than those in a single-family home. Tenants who believe their building has been misclassified or that the wrong standards are being applied can contact the City of Rensselaer's code enforcement office or a local tenant-rights organization to explore available options.
