Plain English

Rochester City Code § 95-3 establishes a systematic distribution process for the city's Tenant and Landlord Bill of Rights and Responsibilities. The Commissioner is responsible for mailing copies to both tenants and landlords of known residential rental properties at least once per year, attaching copies to every certificate of occupancy issued, and providing copies whenever code enforcement officers interact with landlords or tenants. The goal is to ensure that all parties in a residential rental relationship have regular access to this document outlining their respective rights and obligations.

For Property Managers

Under § 95-3, landlords of residential rental properties in Rochester can expect to receive the Bill of Rights and Responsibilities by mail annually, sent to the owner of record on the city's real property tax records and, where applicable, to the local property maintenance person listed on the building owner's registry under § 90-20 of the Property Conservation Code. Compliant operators generally keep their contact information current in both the city's tax records and the building owner's registry to ensure they receive these mailings. Landlords should also expect to receive a copy attached to any certificate of occupancy issued to them.

For Tenants

Section § 95-3 of the Rochester City Code gives tenants of residential rental properties the right to receive the Bill of Rights and Responsibilities by mail once per year, to the best of the city's ability, and as an attachment to any certificate of occupancy issued. Tenants who have not received this document may contact the city's Commissioner's office to request a copy or inquire about the distribution process. Local tenant-rights organizations can also help tenants understand the contents of the Bill of Rights and Responsibilities and explain how its provisions may apply to their rental situation.
