For Property Managers

Under ch. 108 § 108-34, compliant property operators ensure that all fuel oil storage tanks are equipped with venting, are installed to avoid hazard to the property and neighbors, and are maintained in that condition over time. Operators also verify that fill, vent, and drain piping is fixed in place, that underground tank pipes pitch toward the tank, and that fill and vent pipe terminals are located outside the building at a safe distance from any openings. Buildings with automatically operated oil-fired boilers or furnaces are equipped with a remote control capable of stopping oil flow in the event of a fire or other emergency.

For Tenants

Rye, N.Y., Code of Ordinances ch. 108 § 108-34 gives tenants a basis to raise concerns if fuel oil equipment in their building appears improperly installed, lacks required venting, or lacks an emergency shutoff for oil-fired heating systems. Tenants who observe conditions that may not meet these standards can report them to the City of Rye's code enforcement or building department for inspection. Tenant-rights organizations familiar with local housing codes can also help residents understand what options may be available when fuel oil equipment appears to fall short of the requirements in § 108-34.
