Section 108-36 of Rye, N.Y., Code of Ordinances Chapter 108 establishes safety and maintenance standards for elevators, dumbwaiters, and escalators in multiple dwellings. The rule requires that these systems be kept free of physical and fire hazards, that cars display rated-capacity signs in conspicuous locations, and that emergency signaling devices be functional. Hoistways, pits, and machine rooms must be kept clean and uncluttered, flammable liquids are prohibited from machine rooms, and no one may disable required safety or electrical protective devices except during authorized tests, inspections, or maintenance.
Plain English — not legal advice.
Operators of multiple dwellings subject to § 108-36 of Rye's Code of Ordinances generally keep elevator, dumbwaiter, and escalator systems in continuous compliance by conducting routine inspections to confirm that capacity signs are posted, emergency signaling devices are operational, and hoistways and pits are clear of refuse. Machine rooms are kept free of oil, grease, and unnecessary stored materials, and flammable liquids are removed entirely from those spaces. Compliant operators also ensure that safety and electrical protective devices are never disabled outside of formally scheduled tests, inspections, or maintenance activities.

Tenants in Rye multiple dwellings are protected by § 108-36, which requires building owners to maintain elevators, dumbwaiters, and escalators in a hazard-free condition, including functional emergency signals and properly posted capacity signs. If a tenant observes conditions such as missing capacity signs, blocked hoistways, cluttered machine rooms, or disabled safety devices, those observations may be relevant to a housing code complaint filed with the appropriate local code enforcement authority. Tenant-rights organizations familiar with Rye's housing code can help residents understand available options for reporting violations or raising them in relevant proceedings.
