For Property Managers

Under ch. 108 § 108-38, compliant property operators generally inspect drainage systems, fences, and paved surfaces on a routine basis to catch deterioration before it becomes a code issue. Maintaining gutters, culverts, and similar drainage infrastructure in working order, repairing cracked or uneven walkways and driveways, and clearing yards of debris and hazardous vegetation are all part of standard property upkeep under this provision. Operators also monitor for heavy undergrowth or plant accumulations that could be deemed noxious or detrimental to health and address them promptly.

For Tenants

Section 108-38 of Rye's Code of Ordinances gives tenants a basis to raise concerns when outdoor areas—such as drainage systems, fences, walkways, or yards—are not maintained in the safe and clean condition the provision requires. Tenants who observe standing water, unsafe fencing, hazardous pavement, or overgrown vegetation may report these conditions to the appropriate Rye municipal code enforcement office. Tenant-rights organizations can help explain how documented complaints or inspection records may be relevant if a habitability or safety dispute arises.
