Plain English

Rye, N.Y., Code of Ordinances ch. 108 § 108-43 establishes that property owners bear ultimate responsibility for complying with the housing chapter's requirements, even when operators or occupants also carry duties under the same chapter. Private agreements that shift responsibility to another party do not relieve the owner of legal accountability. Owners are additionally responsible for keeping service facilities properly maintained and operational, and for supplying adequate heat and hot water in multiple dwellings.

For Property Managers

Under § 108-43, property owners in Rye cannot rely on lease clauses, management contracts, or other private arrangements to transfer their compliance obligations to operators or tenants. Compliant operators generally maintain service facilities in proper working order, ensure heat and hot water meet adequacy standards in multi-unit buildings, and treat their own obligations as primary regardless of what any agreement with another party says. Documenting maintenance schedules, service records, and utility system inspections is a practice commonly associated with demonstrating ongoing compliance with this provision.

For Tenants

Section 108-43 of Rye's Code of Ordinances gives tenants a meaningful baseline: the owner of the premises is responsible for proper maintenance of service facilities and for providing adequate heat and hot water in multiple dwellings, and that responsibility cannot be contracted away. If a landlord claims that a management company or another party bears responsibility for a deficiency, this provision makes clear that the owner remains accountable regardless. Tenants who experience failures in heat, hot water, or service facilities may consider documenting the conditions, notifying the owner in writing, and reaching out to Rye's local code enforcement office or a tenant-rights organization to understand available complaint and enforcement paths.
