Plain English

Section 108-45 of Rye, N.Y., Code of Ordinances Chapter 108 places a set of maintenance and conduct responsibilities directly on the people who live in dwelling units, rather than solely on property owners. Occupants are required to keep their portion of the premises clean, safe, and sanitary; respect maximum occupancy limits; keep exits clear; properly dispose of refuse; and control pets. When a pest infestation is confined to a single unit, the occupant of that unit—not the landlord—bears responsibility for extermination under this section.

For Property Managers

Under § 108-45, Rye's housing code shifts certain day-to-day maintenance duties to occupants themselves, which affects how compliant operators structure lease agreements and property management practices. Landlords generally document occupancy limits, refuse facilities, and screen requirements in lease terms so that tenants are on clear notice of the obligations this section assigns to them. When a code inspection arises, operators familiar with § 108-45 are prepared to demonstrate which responsibilities belong to the occupant versus the owner under Chapter 108.

For Tenants

Section 108-45 of Rye's Code of Ordinances Chapter 108 outlines duties that fall on you as an occupant, including keeping your unit sanitary, exits unobstructed, and pets under control. Understanding these responsibilities matters because a landlord or code-enforcement officer may cite this section if conditions in your unit fall short of the listed standards. If you believe a violation has been attributed to you incorrectly—for example, a pest infestation that extends beyond your unit—tenant-rights organizations or a housing attorney can help you understand how § 108-45 applies to your circumstances.
