Rye, N.Y., Code of Ordinances ch. 108 § 108-57
Severability
Operative Text
If a term, part, provision, section, subsection or paragraph of this chapter shall be held unconstitutional, invalid or ineffective in whole or in part, such determination shall not be deemed to invalidate the remaining terms, parts, provisions, sections, subsections and paragraphs.
Section 108-57 of Rye's Code of Ordinances Chapter 108 establishes a severability rule, meaning that if any individual part of the chapter is found unconstitutional, invalid, or unenforceable by a court, that finding applies only to that specific part. The rest of the chapter continues to operate as if the invalidated portion were never there. This is a standard legal safeguard designed to preserve as much of the ordinance as possible when any single element is successfully challenged.
Plain English — not legal advice.
Under § 108-57, property owners and managers can generally rely on the remaining provisions of Chapter 108 remaining in force even if a court strikes down one particular section. Compliant operators typically continue following all other requirements of the chapter regardless of any legal challenge to a specific part. Staying informed about any court rulings affecting Chapter 108 helps operators understand which, if any, provisions may be affected at a given time.

Section 108-57 means that a successful legal challenge to one part of Chapter 108 does not automatically eliminate the protections or requirements found in other sections of the chapter. Tenants can generally continue to rely on the broader framework of Chapter 108 even if a specific provision within it is invalidated. Tenant-rights organizations or legal aid services can help clarify which parts of the chapter remain in effect if a particular provision has been challenged.
