Schenectady, N.Y., Code of Ordinances ch. 167 § 167-4
Nonapplicability
Operative Text
A. This chapter shall not apply to mobile housing premises, migrant housing premises and to nursing, convalescent and old-age homes, or similar institutional occupancies. B. This chapter shall not apply to fallout shelters constructed or installed to provide safety and security to occupants in accordance with specifications and standards contained in regulations or orders issued by the New York State Civil Defense Commission or other analogous or successor body.
Schenectady, N.Y., Code of Ordinances ch. 167 § 167-4 carves out specific categories of housing from the requirements of Chapter 167. Mobile housing premises, migrant housing premises, nursing homes, convalescent homes, old-age homes, and similar institutional occupancies are all excluded from the chapter's coverage. Fallout shelters built or installed in compliance with New York State Civil Defense Commission standards—or those of any successor body—are likewise exempt from the chapter's rules.
Plain English — not legal advice.
Operators of properties that fall into the exempt categories listed in § 167-4—such as mobile housing, migrant housing, nursing homes, or qualifying fallout shelters—generally do not need to comply with the requirements of Chapter 167. Compliant operators of these facility types typically document the nature of their occupancy or shelter construction standards to support the exemption if it is ever questioned. Operators of conventional residential rental properties, however, should not assume this exemption applies to them simply because their property shares some characteristics with an exempt category.

Section 167-4 of Schenectady's Code of Ordinances identifies the types of housing that fall outside Chapter 167's protections, which means residents of conventional rental housing are generally still covered by the chapter's provisions. Tenants living in mobile housing, migrant housing, or institutional settings such as nursing or old-age homes should be aware that the protections of Chapter 167 may not extend to their situation. Those uncertain about whether their housing falls within or outside the chapter's scope may find it helpful to consult a local tenant-rights organization or housing authority for general information.
