Schenectady, N.Y., Code of Ordinances ch. 167 § 167-7
General safety
Operative Text
Installations, alterations and repairs to residential premises and materials, assemblies and equipment utilized in connection therewith shall be reasonably safe to persons and property and in conformity with applicable statutes of the State of New York and orders, rules and regulations issued by authority thereof. Conformity of such work, materials, assemblies or equipment with the applicable requirements of the Building Code of the City of Schenectady, the National Electrical Code and the Building Code of the State of New York shall be prima facie evidence that the same is reasonably safe to person and property.
Section 167-7 of Schenectady's Code of Ordinances requires that any installation, alteration, or repair work done on residential property—along with the materials and equipment used—must be reasonably safe for people and property and must comply with applicable New York State law. Work that meets the standards of the City of Schenectady Building Code, the National Electrical Code, or the New York State Building Code is treated as presumptively safe under this provision, though compliance with those codes is not the only way to satisfy the safety requirement.

Under § 167-7, property owners and managers overseeing residential installations, alterations, or repairs generally ensure that all work and associated materials conform to the Schenectady Building Code, the National Electrical Code, and the New York State Building Code, as these standards serve as prima facie evidence of reasonable safety. Operators typically document permits, inspections, and contractor qualifications to demonstrate that completed work meets the applicable state statutes and local regulations. Maintaining records of code-compliant work helps establish that the general safety standard of § 167-7 has been satisfied.

Section 167-7 establishes a baseline safety standard for residential installations, alterations, and repairs, meaning tenants have a right to expect that work performed on their home and the materials used meet reasonable safety requirements under New York State law and local codes. If a tenant believes that work or equipment in their unit is unsafe or was performed without proper code compliance, they may consider contacting the City of Schenectady's code enforcement or building department to request an inspection. Tenant-rights organizations in the Schenectady area can also help residents understand how § 167-7 may apply to conditions in their home and what general enforcement paths are available.
