Syracuse, N.Y., Rev. Gen. Ord. ch. 27 § 27-164
Certificate of use required
Operative Text
(a) No proprietor shall operate or maintain a business within the city of Syracuse without first having obtained a certificate of use or conditional certificate of use authorizing the operation of said business by said proprietor at the specific business location. (b) No owner shall allow a business to be operated or maintained at the premises without requiring proprietor to obtain a certificate of use or conditional certificate of use authorizing the operation of said business by said proprietor at the specific business location. (c) Any business operating without a valid certificate of use shall be considered "unlawful" pursuant to the provisions of section 107.1.4 of the 2010 Property Maintenance Code of New York State and may be subject to immediate closure by the division of code enforcement.
Syracuse Rev. Gen. Ord. ch. 27, art. 12 § 27-164 establishes that every business operating within Syracuse must hold a valid certificate of use or conditional certificate of use tied to a specific location and proprietor before it can lawfully open. Both the person running the business and the property owner bear responsibility for ensuring this credential is in place. A business that lacks a valid certificate is classified as unlawful under the 2010 Property Maintenance Code of New York State and may be shut down immediately by the city's division of code enforcement.
Plain English — not legal advice.
Under Syracuse Rev. Gen. Ord. ch. 27, art. 12 § 27-164, property owners who lease or otherwise make space available for commercial use generally verify that any proprietor operating at their premises has obtained the required certificate of use or conditional certificate of use before business operations begin. Compliant owners typically include lease provisions that require tenants to secure and maintain this certificate throughout the tenancy. Allowing a business to operate without that credential exposes the owner to potential enforcement action alongside the proprietor.

Syracuse Rev. Gen. Ord. ch. 27, art. 12 § 27-164 places the obligation to obtain a certificate of use squarely on the proprietor operating the business, but it also makes the property owner responsible for ensuring that credential exists. If you are a commercial tenant or business operator who has been denied a certificate, received a closure notice, or believes enforcement action is being taken improperly, general paths include contacting the Syracuse division of code enforcement for clarification, reviewing the certificate application process through the city, or reaching out to a tenant-rights or small-business advocacy organization familiar with local code requirements.
