Plain English

Syracuse Rev. Gen. Ord. ch. 27, art. 2 § 27-19 establishes that dwellings required to hold a certificate of compliance, certificate of suitability, and/or rental registry certificate generally cannot be occupied without those documents in place. However, the rule carves out a limited exception: a dwelling may still be occupied if the owner has submitted an application for the required certificate to the appropriate city authority—the director, the Zoning Administrator, or the Division of Code Enforcement—and that application has been accepted and remains open, pending, and active. This provision ties lawful occupancy directly to a property's certification status or the active pursuit of that status.

For Property Managers

Under Syracuse Rev. Gen. Ord. ch. 27, art. 2 § 27-19, compliant property operators ensure that any dwelling subject to certification requirements holds a valid certificate of compliance, certificate of suitability, and/or rental registry certificate before tenants move in. When a certificate is not yet in hand, operators who have submitted an application to the director, the city Zoning Administrator, or the Division of Code Enforcement—and whose application has been accepted and remains open and active—may still allow occupancy under the provision's exception. Keeping documentation of application status current and accessible is a practice consistent with meeting the requirements of this section.

For Tenants

Syracuse Rev. Gen. Ord. ch. 27, art. 2 § 27-19 gives tenants a basis to inquire whether their dwelling holds the required certificate of compliance, certificate of suitability, and/or rental registry certificate, or whether a qualifying application is actively on file with the city. If a property appears to lack both a valid certificate and an active pending application, that may constitute a violation of this provision that can be raised with the Syracuse Division of Code Enforcement or the Zoning Administrator. Tenant-rights organizations familiar with Syracuse housing law can help residents understand what records they may request and what options exist when a property does not appear to meet the certification requirements of § 27-19.
