Syracuse, N.Y., Rev. Gen. Ord. ch. 27 § 27-45
Prevention of fire spread
Operative Text
(a) Walls and ceilings shall be maintained free from cracks and openings which would permit flame or excessive heat to enter the concealed space. (b) In buildings of mixed occupancy, non-residential space shall be separated from residential space by approved fire separations which will retard the spread of fire. (c) Garages in or attached to a residential building shall be separated from other spaces in the building by approved fire separations which will retard the spread of fire and prevent flammable or toxic vapors originating within the garage from being transmitted to other parts of the building.
Syracuse Rev. Gen. Ord. ch. 27, art. 5 § 27-45 establishes structural fire-spread prevention requirements for residential buildings. Walls and ceilings must be kept free of cracks or openings that could allow flames or excessive heat to reach concealed spaces. In buildings that mix residential and non-residential uses, approved fire separations must divide those areas, and any garage that is part of or attached to a residential building must be separated from the rest of the structure in a way that also blocks flammable or toxic vapors from spreading.

Under Syracuse Rev. Gen. Ord. ch. 27, art. 5 § 27-45, compliant property operators routinely inspect walls and ceilings for cracks or gaps and repair them promptly to prevent heat or flame from reaching concealed cavities. In mixed-use buildings, operators ensure that code-approved fire separations are installed and maintained between residential and non-residential areas. Where a garage is attached to or part of a residential structure, operators verify that approved separations are in place and functioning to block both fire and hazardous vapors from migrating into living spaces.

Syracuse Rev. Gen. Ord. ch. 27, art. 5 § 27-45 gives tenants a basis to expect that their building's walls, ceilings, and any shared boundaries with garages or commercial spaces are properly sealed and fire-separated. If a tenant observes cracks in walls or ceilings, missing fire barriers, or detects fumes from an attached garage entering living areas, these conditions may constitute a violation of this provision. Tenants can report such concerns to the City of Syracuse's code enforcement office, raise the issue as a habitability matter, or reach out to a local tenant-rights organization to understand available options.
