Utica, N.Y., Code of Ordinances ch. 2-12 § 2-12-532
Registration of existing and new rental dwelling units
Operative Text
(a) All owner-occupied two-family dwellings and rental dwelling units existing as of the effective date of this chapter shall be registered on or before April 30, 2006. (b) The owner of a new rental dwelling unit or any dwelling newly converted to a rental dwelling unit shall register the rental dwelling unit prior to allowing occupancy of any new rental unit.
Utica, N.Y., Code of Ordinances ch. 2-12 § 2-12-532 establishes two registration timelines for rental dwelling units. Rental units and owner-occupied two-family dwellings that existed when the chapter took effect were required to be registered by April 30, 2006. For any dwelling unit that is newly built or newly converted to rental use after that date, registration must be completed before any tenant is allowed to move in.
Plain English — not legal advice.
Under ch. 2-12 § 2-12-532, compliant operators ensure that every new rental unit or newly converted rental dwelling is registered with the city before a tenant takes occupancy — not after. Property owners who acquired or converted rental properties after the chapter's effective date treat registration as a prerequisite step in the leasing process, completing it before advertising or granting access to a unit. Maintaining documentation of registration is a common practice for demonstrating compliance if questions arise.

Section 2-12-532 of Utica's Code of Ordinances requires that rental units be registered before occupancy is permitted, which means tenants have an interest in knowing whether their unit was properly registered before they moved in. If a unit was not registered as required, that fact may be relevant to housing code enforcement or other proceedings, and tenants can inquire with the City of Utica about a unit's registration status. Tenant-rights organizations in the Utica area can help residents understand what options may be available when a landlord has not followed registration requirements.
