Watervliet, N.Y., Code of Ordinances ch. 175 § 175-18
Powers of the Board
Operative Text
The Board of Appeals shall have the power and duties prescribed by statute and by this chapter, which powers and duties are hereby summarized and more particularly specified: A. Interpretation. On appeal from a determination of the enforcement officer, or on request by an official, department or board of the city, the Board of Appeals shall decide any question involving the interpretation of any provision of this chapter. B. Variances. On appeal from a determination of the enforcement officer, the Board of Appeals may grant a variance where the strict application of this chapter would result in practical difficulty or unnecessary hardship.
Section 175-18 of Watervliet's Code of Ordinances establishes the powers of the Board of Appeals in two main areas. First, the Board has authority to interpret any provision of Chapter 175 when an appeal is filed against an enforcement officer's decision or when a city official, department, or board requests clarification. Second, the Board may grant variances from the chapter's strict requirements when their rigid application would create practical difficulty or unnecessary hardship for a property owner.

Under § 175-18, property owners who receive an adverse determination from the enforcement officer have a formal avenue to seek relief through the Board of Appeals. A compliant operator generally documents the basis for any claimed hardship or practical difficulty before pursuing a variance request, and keeps records of all enforcement officer communications. Operators also monitor whether any city department or board has sought an interpretation of Chapter 175 that could affect their properties.

Section 175-18 gives the Board of Appeals the authority to interpret Chapter 175 provisions, which means tenants may have standing to participate in or monitor appeal proceedings that affect their housing. If an enforcement officer's determination is appealed by a landlord seeking a variance, tenants in the affected property can look into whether they have the right to present information to the Board. Tenant-rights organizations familiar with Watervliet's local ordinances can help residents understand how Board of Appeals proceedings under § 175-18 may relate to their housing situation.
