For Property Managers

Operators of residential properties in Watervliet are generally expected to conduct routine inspections of walls and ceilings to identify and repair any cracks or gaps that could compromise fire containment, as required under ch. 175 § 175-35. In mixed-use buildings, compliant operators ensure that approved fire-separation assemblies are installed and maintained between nonresidential and residential spaces. Where a garage is attached to or located within a residential building, property managers typically verify that code-approved fire separations are in place and intact to prevent the passage of both fire and hazardous vapors.

For Tenants

Under Watervliet, N.Y., Code of Ordinances ch. 175 § 175-35, tenants in residential buildings have an interest in knowing that walls, ceilings, and fire separations are properly maintained to limit fire spread and vapor intrusion. If a tenant observes cracks in walls or ceilings, missing or damaged fire separations, or detects fumes from an attached garage, these conditions may constitute code violations that can be reported to the local code enforcement or building department. Tenants may also wish to consult a tenant-rights organization to understand how such violations could be raised in housing proceedings or other enforcement contexts.
