Yonkers, N.Y., Code of Ordinances ch. 58 § 58-28
Discontinuance or interruption of service
Operative Text
No person shall cause any service facility, equipment or utility which is required under this chapter or the New York Uniform Code to be removed from or shut off or discontinued from any occupied dwelling, except for such temporary interruptions as may be necessary while actual repairs or alterations are in process or during temporary emergencies when discontinuance of service is approved by the Commissioner of the Department of Housing and Buildings.
Section 58-28 of the Yonkers Code of Ordinances prohibits anyone from removing, shutting off, or discontinuing a required service, facility, equipment, or utility in an occupied dwelling. The rule applies to services mandated by Chapter 58 or the New York Uniform Code. Limited exceptions exist for genuine repair work in progress or temporary emergencies, but only when the Commissioner of the Department of Housing and Buildings has approved the discontinuance in the emergency situation.
Plain English — not legal advice.
Under § 58-28, compliant property operators maintain all required services, facilities, equipment, and utilities in occupied units without interruption. When repairs or alterations genuinely necessitate a temporary service outage, operators document the work in progress and keep the interruption as brief as possible. In emergency situations requiring a longer discontinuance, operators seek advance approval from the Commissioner of the Department of Housing and Buildings before cutting off any required service.

Section 58-28 gives occupants of Yonkers dwellings a right to continuous access to all services, facilities, equipment, and utilities required under Chapter 58 and the New York Uniform Code. If a landlord removes or shuts off a required service outside of an approved emergency or active repair work, that action may constitute a violation of this provision. Tenants who believe a service has been improperly discontinued can document the interruption, contact the Yonkers Department of Housing and Buildings to report the potential violation, or reach out to a local tenant-rights organization to understand available options.
