Yonkers, N.Y., Code of Ordinances ch. 58 § 58-8
Temporary residences
Operative Text
A. No person shall operate or maintain a rooming house without having secured a permit on a form prescribed by the Commissioner. B. No permit shall be issued by the Commissioner unless the rooming house is in compliance with all applicable provisions of the New York Uniform Code and the Yonkers Fire and Building Code. C. At the time of application for a permit, certificates of compliance from the Department of Housing and Buildings and the Fire Department of the City of Yonkers shall be presented by the applicant. D. After approval of the rooming house by the Commissioner, a permit shall be issued. All permits issued shall remain the property of the Department and shall, on demand, be surrendered to an authorized representative of the Department whenever such permit expires, is suspended or is revoked. Such permit, when issued, shall be posted in a conspicuous place in the rooming house and shall be kept clean at all times and protected against mutilation, soil and damage. Permits shall not be transferable.
Section 58-8 of the Yonkers Code of Ordinances establishes a permit requirement for rooming houses, which are a form of temporary residence. Under this provision, a rooming house may not legally operate without a valid permit issued by the Commissioner, and that permit can only be granted after the facility demonstrates compliance with the New York Uniform Code and the Yonkers Fire and Building Code. The permit must be visibly posted on the premises, is non-transferable, and remains the property of the Department, meaning it must be returned if it expires, is suspended, or is revoked.

Operators of rooming houses in Yonkers must obtain a permit under § 58-8 before opening or continuing operations, which means securing compliance certificates from both the Department of Housing and Buildings and the Yonkers Fire Department prior to submitting an application to the Commissioner. Once a permit is issued, compliant operators keep it posted in a conspicuous location within the rooming house, maintain it in clean and undamaged condition, and do not attempt to transfer it to another party or property. Because the permit remains the property of the Department, operators are expected to surrender it promptly upon expiration, suspension, or revocation.

Section 58-8 of the Yonkers Code of Ordinances gives tenants in rooming houses a basis to verify that their residence is legally operating — a valid, visibly posted permit is required at all times. If no permit is posted or a permit appears expired, suspended, or revoked, tenants may report the concern to the Yonkers Department of Housing and Buildings or the Commissioner's office, and may also consult a local tenant-rights organization to understand how this violation could affect their housing situation. The non-transferability of permits under § 58-8 also means that a change in ownership or management does not automatically carry over an existing permit, which can be relevant context when a rooming house changes hands.
