24 C.F.R. § 35.700
§ 35.700 Purpose and applicability. (24 CFR Part 35)
Operative Text
(a) This subpart H establishes procedures to eliminate as far as practicable lead-based paint hazards in residential properties receiving project-based assistance under a HUD program. The requirements of this subpart apply only to the assisted dwelling units in a covered property and any common areas servicing those dwelling units. This subpart does not apply to housing receiving rehabilitation assistance or to public housing, which are covered by subparts J and M of this part, respectively. (b) For the purposes of competitively awarded grants under the Housing Opportunities for Persons with AIDS Program (HOPWA), the Supportive Housing Program (42 U.S.C. 11381-11389) and the Shelter Plus Care Program project-based rental assistance and sponsor-based rental assistance components (42 U.S.C. 11402-11407), the requirements of this subpart shall apply to grants awarded pursuant to Notices of Funding Availability published on or after October 1, 1999. For the purposes of formula grants awarded under the Housing Opportunities for Persons with AIDS Program (HOPWA) (42 U.S.C. 12901 et seq.), the requirements of this subpart shall apply to activities for which program funds are first obligated on or after September 15, 2000.
Section 35.700 sets out the scope and purpose of Subpart H of 24 CFR Part 35, which is designed to reduce lead-based paint hazards in HUD-assisted residential properties to the greatest extent feasible. The rules under this section cover only the assisted dwelling units themselves and any shared spaces that serve those units — not the entire property. Notably, properties receiving rehabilitation assistance or classified as public housing fall outside this subpart's reach, as those are governed by separate subparts within the same regulation.
Plain English — not legal advice.
Operators of properties receiving project-based HUD assistance should be aware that § 35.700 triggers lead-based paint hazard reduction obligations for assisted units and their associated common areas. Compliant operators typically identify which units and shared spaces fall under Subpart H coverage and ensure those areas are evaluated and maintained according to the subpart's requirements. Properties under rehabilitation assistance or public housing programs are governed by different subparts, so operators managing mixed portfolios generally track which regulatory framework applies to each property type.

Section 35.700 establishes that residents living in HUD project-based assisted units have protections under Subpart H aimed at reducing lead-based paint hazards in their homes and shared spaces. If a tenant believes their assisted unit or a common area has not been properly addressed for lead-based paint hazards, they may raise a potential violation with their local HUD field office or a tenant-rights organization familiar with federal housing regulations. Tenants in public housing or properties receiving rehabilitation assistance should note that § 35.700 directs those situations to different subparts, and a housing counselor or tenant advocacy group can help clarify which rules apply.
