24 C.F.R. § 882.413
§ 882.413 Responsibility of the Family. (24 CFR Part 882)
Operative Text
(a) A family receiving housing assistance under this Program must fulfill all of its obligations under the Lease and Statement of Family Responsibility. (b) No family member may engage in drug-related criminal activity or violent criminal activity. Failure of the Family to meet its responsibilities under the Lease, the Statement of Family Responsibility, or this section shall constitute rounds for termination of assistance by the PHA. Should the PHA determine to terminate assistance to the Family, the provisions of § 882.514(f) must be followed.
Under 24 CFR Part 882 § 882.413, families participating in the Section 8 Moderate Rehabilitation Program are required to meet all obligations set out in their Lease and Statement of Family Responsibility. The rule also prohibits any household member from engaging in drug-related or violent criminal activity. When a family fails to meet these responsibilities, the provision establishes that the Public Housing Authority (PHA) has grounds to terminate the family's housing assistance, subject to the procedural requirements of § 882.514(f).

Under 24 CFR Part 882 § 882.413, compliant operators generally document any known lease violations, drug-related criminal activity, or violent criminal activity involving household members and report such activity to the administering PHA. When a PHA determines that grounds for termination of assistance exist under this section, property owners typically coordinate with the PHA to ensure that the procedural steps outlined in § 882.514(f) are properly followed before assistance is terminated. Maintaining clear records of lease compliance and any incidents involving household members supports the orderly administration of the program.

Under 24 CFR Part 882 § 882.413, participating families have a right to know the specific obligations outlined in their Lease and Statement of Family Responsibility, as these documents define the standards by which continued assistance is measured. If a PHA moves to terminate assistance based on this section, the procedural protections of § 882.514(f) must be followed, which generally includes notice and an opportunity to respond. Tenants who receive a notice of termination may wish to review those procedural requirements carefully, contact a local tenant-rights organization, or seek guidance from a HUD-approved housing counseling agency to understand available options.
