24 C.F.R. § 886.335
§ 886.335 Management and occupancy reviews. (24 CFR Part 886)
Operative Text
(a) The contract administrator will conduct management and occupancy reviews to determine whether the owner is in compliance with the Contract. Such reviews will be conducted in accordance with a schedule set out by the Secretary and published in the Federal Register, following notice and the opportunity to comment. Where a change in ownership or management occurs, a management and occupancy review must be conducted within six months. (b) HUD or the Contract Administrator may inspect project operations and units at any time. (c) Equal Opportunity reviews may be conducted by HUD at any time.
Under 24 CFR Part 886 § 886.335, the contract administrator is required to periodically assess whether owners are meeting their contractual obligations, following a review schedule that HUD publishes in the Federal Register after public notice and comment. When ownership or management of a project changes hands, a review must take place within six months of that transition. Beyond scheduled reviews, HUD or the contract administrator may examine project operations and individual units at any point, and HUD retains the authority to conduct Equal Opportunity reviews without advance scheduling.
Plain English — not legal advice.
Operators subject to 24 CFR Part 886 § 886.335 are generally expected to maintain records and project conditions that can withstand scrutiny at any time, since both scheduled and unannounced inspections are permitted under this provision. When a property changes ownership or management, compliant operators typically ensure that a review can be completed within the six-month window that follows such a transition. Staying current with HUD's Federal Register publications helps owners understand the cadence of scheduled management and occupancy reviews and prepare accordingly.

Section 886.335 establishes that tenants living in projects covered by this provision benefit from ongoing oversight: the contract administrator conducts periodic compliance reviews, and HUD or the contract administrator may inspect units and operations at any time. If residents have concerns about whether their property is being managed in accordance with its contract, they may raise those concerns with the contract administrator or HUD, or seek guidance from a local tenant-rights organization familiar with HUD-assisted housing. Equal Opportunity reviews conducted by HUD under this provision also provide an additional layer of protection for residents who believe fair housing standards are not being upheld.
