24 C.F.R. § 891.135
§ 891.135 Amount and terms of capital advances. (24 CFR Part 891)
Operative Text
(a) Amount of capital advances. The amount of capital advances approved shall be the amount stated in the notification of fund reservation, including any adjustment required by HUD before the final closing. The amount of the capital advance may not exceed the appropriate development cost limit. (b) Estimated development cost. The amount of the capital advance may not exceed the total estimated development cost of the project (as determined by HUD), less the incremental development cost associated with excess amenities and design features to be paid for by the Sponsor under § 891.120.
Under 24 CFR Part 891 § 891.135, the federal government caps the size of capital advances provided to housing project sponsors at two distinct ceilings: the development cost limit set by HUD for the applicable project type, and the total estimated development cost of the project as HUD determines it. Any portion of development costs tied to amenities or design features that exceed HUD's standards must be funded by the sponsor separately and are excluded from the capital advance calculation. HUD retains the authority to adjust the approved advance amount before final closing, meaning the figure stated in the initial fund reservation notice is not necessarily final.
Plain English — not legal advice.
Operators and sponsors pursuing HUD capital advances under § 891.135 should be aware that the advance amount confirmed in the fund reservation notice may be revised by HUD prior to final closing, so project budgets are generally structured with that possibility in mind. Compliant sponsors typically ensure that any amenities or design features exceeding HUD's baseline standards are budgeted and funded independently, as those incremental costs are excluded from the capital advance under § 891.135(b). Keeping development cost documentation current and aligned with HUD's cost limit schedules is a practice commonly associated with smooth final closings under this provision.

For residents of housing developed under HUD's Section 891 program, § 891.135 establishes the financial framework that governs how much federal capital support a project can receive, which in turn shapes the scope and features of the housing being built. Tenants who believe a project's financing or amenity structure may not comply with HUD's capital advance rules can raise concerns with the local HUD field office or a tenant-rights organization familiar with federally assisted housing. Understanding that § 891.135 limits what costs can be covered by the capital advance may help tenants contextualize decisions about project amenities and design that sponsors communicate during development.
