HUD HCV Guidebook § 8
The term “Owner” refers to any person or entity with the legal right to lease or sublease a unit to a
participant. Owner responsibilities are defined in the HAP contract, lease, and HUD regulations. The
owner is responsible for the following69:
Performing all management and rental functions for the assisted unit, including selecting a
voucher holder to lease the unit and deciding if the family is suitable for tenancy; The fact
that an applicant is or has been a victim of domestic violence, dating violence, sexual assault,

or stalking, is not an appropriate basis for denial of tenancy if the applicant otherwise
qualifies for tenancy.
Maintaining the unit in accordance with HQS, including performing ordinary and extraordinary
maintenance;
Complying with equal opportunity requirements;
Preparing and furnishing to the PHA information required under the HAP contract;
Collecting from the family any security deposit, the family rent to owner, and any charges for
unit damage by the family;
Enforcing tenant obligations under the lease; and
Paying for utilities and services, unless paid for by the family under the lease.Source: Legislative text reproduced verbatim
