1. PURPOSE
Section 6.2 of “Implementation Guidance: Sections 102 and 104 of the Housing
Opportunity Through Modernization Act of 2016 (HOTMA)” (Notice H 2023–10)
establishes a date of January 1, 2025, by which Multifamily Housing (MFH) Owners must
be in full compliance with the HOTMA final rule.1 The purpose of this Notice 2025–07 is to
extend the compliance date to January 1, 2027.

date to January 1, 2026. This Notice however extends the compliance date to January 1,

Housing Opportunity Through Modernization Act of 2016: Implementation of Sections 102, 103, and 104, 88 Fed.
Reg. 9600 (Feb. 14, 2023).
Housing Notice § 2025-07 extends the deadline by which Multifamily Housing owners participating in certain HUD programs must achieve full compliance with the income and asset documentation requirements introduced by Sections 102 and 104 of the Housing Opportunity Through Modernization Act of 2016 (HOTMA). The original compliance date of January 1, 2025, was first pushed to January 1, 2026, and is now moved again to January 1, 2027. This means that income certifications with effective dates on or after January 1, 2027, must conform to the updated HOTMA final rule standards.
Plain English — not legal advice.
Property owners and managers participating in HUD Multifamily Housing programs covered by Notice H 2023–10 should be aware that Housing Notice § 2025-07 has reset the full-compliance deadline to January 1, 2027. Compliant operators generally use this extended window to update their income and asset documentation procedures, train staff on the revised certification requirements, and ensure their systems are ready well before the new deadline. Questions about program-specific obligations can be directed to HUD at MFH_HOTMA@hud.gov.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
Tenants living in HUD-assisted multifamily properties may notice changes to how their income and assets are documented during annual or interim recertifications, as Housing Notice § 2025-07 gives property owners until January 1, 2027, to fully implement the updated HOTMA rules. These changes affect how household income and assets are calculated and verified, which can influence rent determinations in assisted housing. Tenants who have questions about how recertification procedures apply to them may wish to contact their local HUD office, a HUD-approved housing counselor, or a tenant-rights organization familiar with federally assisted housing programs.
