PIH Notice § 2010-28 extends the requirements originally established in PIH Notice 2009-23 for public housing agencies (PHAs) to formally designate public housing projects for occupancy by elderly families only, disabled families only, or a combination of both groups. The extension runs from the prior notice's expiration on July 31, 2010, through July 31, 2011, with no substantive changes to the underlying rules. The notice also specifies the administrative procedures PHAs must follow when submitting new, amended, or renewal designation plans to HUD.
Plain English — not legal advice.
Public housing agencies operating under PIH Notice § 2010-28 are generally expected to maintain current designated housing plans that comply with HUD's streamlined designation requirements for elderly-only, disabled-only, or combined elderly and disabled occupancy. New or amended plans must be accompanied by a signed request from the Executive Director and submitted either electronically to PIH.DesignatedHousing@hud.gov or by registered mail to the HUD Office of Public Housing and Voucher Programs in Washington, DC. Renewal plan requests under PIH Notice § 2010-28 are directed to the local Public Housing Field Office, and PHAs should ensure submissions are made within the notice's effective window ending July 31, 2011.

PIH Notice § 2010-28 governs how public housing projects can be officially designated for occupancy by elderly or disabled families, which directly affects eligibility and access to certain public housing developments. Tenants who believe a designation has been improperly applied or who have questions about eligibility at a specific development may contact the nearest HUD Office of Public Housing, whose locations are listed at www.hud.gov. Tenant-rights organizations familiar with public housing rules can also help individuals understand how the designation requirements under PIH Notice § 2010-28 may affect their housing options.
