Ala. Admin. Code r. 535-X-11 § 535-X-11-.13
Used Manufactured Buildings
Operative Text
(1) The following procedure may be used for a used manufactured (modular) building not in compliance with this Chapter and/or that has not previously received an Alabama insignia of compliance to obtain approval for the unit to be sited in Alabama: (a) Plans for used units to be sited in Alabama shall be submitted to the Alabama Manufactured Housing Commission for plan review. Plans for used units must be accompanied by the appropriate fees, a registered architect’s, and a licensed professional engineer’s certification that the unit’s current condition meets or exceeds Alabama standards. The certification must include the model number, serial number, and a statement that the building meets or exceeds the Alabama standards for the construction of manufactured buildings at the time of construction.
Under Alabama Administrative Code r. 535-X-11 § 535-X-11-.13, a used modular (manufactured) building that lacks an Alabama insignia of compliance or otherwise does not meet chapter requirements must go through a specific review process before it can be placed on a site in Alabama. The process requires submitting plans to the Alabama Manufactured Housing Commission along with applicable fees and professional certifications from both a registered architect and a licensed professional engineer. Those certifications must confirm that the building's current condition meets or exceeds Alabama construction standards and must include identifying details such as the model and serial numbers.

Property owners or managers seeking to site a used modular building in Alabama under r. 535-X-11 § 535-X-11-.13 generally engage both a registered architect and a licensed professional engineer to inspect the unit and prepare the required certifications before submission. A compliant operator ensures that the certification documents include the unit's model number, serial number, and a clear statement that the building met or exceeded Alabama standards at the time it was originally constructed. Submitting complete plans and the correct fees to the Alabama Manufactured Housing Commission at the outset helps avoid delays in the plan-review process.

Tenants living in or considering a used modular home in Alabama may find it useful to know that r. 535-X-11 § 535-X-11-.13 establishes a formal approval pathway requiring professional engineering and architectural certification before such a unit can be legally sited in the state. If there are questions about whether a unit received proper approval or holds an Alabama insignia of compliance, the Alabama Manufactured Housing Commission is the body that oversees this review process and may be a starting point for inquiries. Tenant-rights organizations or legal aid services can help individuals understand what options may be available if a unit appears to have been sited without going through the required review.
