Ala. Admin. Code r. 535-X-13 § 535-X-13-.03
Data Plate And Label Requirements
Operative Text
(1) Each section of each home manufactured under the Federal Manufactured Home Construction and Safety Standards shall contain a label issued by the inspection agency. The label indicates that the home meets the applicable standards (FMHCSS) and that the construction process has been monitored by a third-party inspection agency. A shipment/inspection fee may be required for each section of each new manufactured home or manufactured building shipped to a retailer in Alabama; a fee may be required for each section of each manufactured home or manufactured building sold, leased or leased to purchase. This fee would be due monthly for the previous month’s transactions. (2) Each manufactured building (modular) manufactured under the Alabama Manufactured Buildings Act shall contain an insignia issued by the Alabama Manufactured Housing Commission (AMHC). This insignia indicates the manufacturer has met all applicable codes and standards required by the Commission. This insignia is required to be located on the inside door of the electrical panel. (3) Each manufactured home and manufactured building is required to bear a data plate affixed in a permanent manner near the electrical panel or other readily accessible and visible location. The data plate shall contain information, including the name of the manufacturer, design-approval agency, factory installed equipment, and the wind, roof load, and thermal zones for which the unit was constructed. The installer or other authorized inspection personnel shall ensure that the home or building is not located in a zone that exceeds the design limitations for which the unit was constructed. (4) No manufactured home constructed on or after June 15, 1976, may be installed within the State of Alabama unless it contains the HUD label and a data plate (see paragraphs 1 and 3 above). No manufactured building may be installed in Alabama unless it contains an AMHC insignia and a data plate (see paragraphs 2 and 3 above).
Alabama Administrative Code r. 535-X-13 § 535-X-13-.03 establishes labeling and data-plate requirements for manufactured homes and modular buildings sold or installed in Alabama. Every qualifying unit must carry both a federally issued HUD label (or an Alabama Manufactured Housing Commission insignia for modular buildings) and a permanently affixed data plate that records key construction details such as the manufacturer's name, approved equipment, and the wind, roof-load, and thermal zones the unit was built to withstand. No manufactured home built on or after June 15, 1976, and no modular building may be legally installed in Alabama without these required markings. Shipment and inspection fees tied to these certifications may also apply on a monthly basis for prior-month transactions.

Property owners and managers who acquire or place manufactured homes or modular buildings in Alabama should be familiar with r. 535-X-13 § 535-X-13-.03, which requires that every unit bear the appropriate federal HUD label or AMHC insignia along with a permanently affixed data plate before installation. Compliant operators typically verify that the data plate is present, legible, and located near the electrical panel, and that the unit's design zones—wind, roof load, and thermal—are appropriate for the intended installation site. Operators generally also account for applicable shipment and inspection fees, which are reported and paid monthly for the prior month's transactions.

Tenants living in or considering a manufactured home or modular building in Alabama have an interest in knowing that r. 535-X-13 § 535-X-13-.03 requires these units to display a HUD label or AMHC insignia and a data plate confirming the unit's construction standards and design limitations. If a unit appears to be missing these required markings, or if there are concerns that the home was installed in a climate or wind zone beyond its design limits, tenants may consider contacting the Alabama Manufactured Housing Commission, which oversees compliance with these requirements. Tenant-rights organizations and legal aid services can help explain what options may be available when a unit does not appear to meet the labeling standards set out in this provision.
