Ala. Code §§ 35-9-1 to 35-9-100 § 35-9-65
Lien, Rights, and Remedies Vested in Assignee of Claim for Rent.
Operative Text
The lien provided in this division shall vest in any assignee of the claim for rent; and such assignee shall be invested with all the rights of the landlord, and entitled to all his remedies for their enforcement.
Under Alabama Code § 35-9-65, when a landlord transfers or assigns a rent claim to another party, that assignee automatically receives the same statutory lien on the tenant's property that the original landlord held. Along with the lien, the assignee steps into the landlord's legal shoes, gaining access to all the rights and enforcement remedies the landlord would have had. This provision ensures that the transfer of a rent claim does not diminish the legal tools available to collect on it.
Plain English — not legal advice.
Under § 35-9-65, landlords who assign rent claims to a third party — such as a debt purchaser or collection entity — transfer not just the monetary claim but also the statutory lien and all associated enforcement rights. Compliant operators typically document assignments clearly so that the assignee can demonstrate standing to exercise those remedies. Understanding that the full bundle of rights travels with the assignment helps landlords structure such transactions accurately.

Alabama Code § 35-9-65 means that if your landlord has assigned a rent claim to a third party, that assignee holds the same lien rights and enforcement powers as the original landlord. Tenants should be aware that any defenses or disputes that existed against the original landlord's rent claim may still be relevant when dealing with an assignee. Consulting a tenant-rights organization or legal aid service can help clarify what rights and defenses remain available when a rent claim has changed hands.
