Alaska Stat. § 34.03. § 34.03.090
Landlord to supply possession of the dwelling unit
Operative Text
(a) At the commencement of the term the landlord shall deliver possession of the premises to the tenant in compliance with the rental agreement and AS 34.03.100. The landlord may, after serving a notice to quit under AS 09.45.100 — 09.45.105 to a person who is wrongfully in possession, (1) bring an action for possession against any person wrongfully in possession; and (2) recover the damages provided in AS 34.03.290. (b) The tenant shall acknowledge or verify by the tenant's signature the accuracy of the premises condition statement and contents inventory prepared under AS 34.03.020(e). The premises condition statement and contents inventory (1) may be used by the landlord or tenant as the basis (A) to determine whether prepaid rent or a security deposit shall be applied to the payment of damages to the premises when authorized by AS 34.03.070(b); and (B) to compute the recovery of other damages to which the parties may be entitled under this chapter; and (2) is, in an action initiated by a party to recover damages or to obtain other relief to which a party may be entitled under this chapter, presumptive evidence of the condition of the premises and its contents at the commencement of the term of the period of occupancy covered by the rental agreement.
Alaska Statute AS 34.03 § 34.03.090 establishes two related obligations at the start of a tenancy. First, the landlord must hand over the rental unit in a condition that meets the rental agreement and the habitability standards in AS 34.03.100; if a prior occupant refuses to leave, the landlord has legal tools—including a notice to quit and a court action—to remove that person and recover damages. Second, the tenant must sign the premises condition statement and contents inventory prepared under AS 34.03.020(e), and that signed document becomes presumptive evidence of the unit's condition at move-in, which can be used by either party to calculate damage claims or determine how security deposits and prepaid rent are applied.
Plain English — not legal advice.
Under AS 34.03 § 34.03.090, compliant operators ensure the rental unit is ready and legally available on the first day of the tenancy, meeting both the rental agreement's terms and the habitability requirements of AS 34.03.100. If a holdover occupant is still present, landlords generally serve a proper notice to quit under AS 09.45.100–09.45.105 before pursuing a court action for possession and any associated damages under AS 34.03.290. Landlords also prepare a thorough premises condition statement and contents inventory under AS 34.03.020(e) and obtain the incoming tenant's signature on it, since that document anchors any future dispute over security deposits or damage claims.

AS 34.03 § 34.03.090 gives tenants the right to receive the rental unit in a legally habitable and agreement-compliant condition from the very first day of the lease term. The premises condition statement and contents inventory that a tenant signs at move-in carries significant weight—it serves as presumptive evidence of the unit's condition at the start of occupancy and can be used to contest improper deductions from a security deposit or prepaid rent. Tenants who believe a landlord failed to deliver proper possession, or who face disputes over move-in conditions, may find it useful to consult a tenant-rights organization or review the remedies available under AS 34.03.290 and related provisions.
